ShapeCard is a financial technology company, not a bank. Banking services and cards will be provided by our bank partner (Pending bank partner).
For parents, guardians, caregivers and anyone else who manages a card for another person.
These terms apply to you when you act as an approver: a person who applies for, sets rules on, or approves purchases on a ShapeCard card for someone else (the cardholder). They are in addition to the Cardholder Agreement, the Terms of Use and the Privacy Policy. Words defined in the Cardholder Agreement have the same meaning here.
A cardholder has one approver at a time. You may be an approver for more than one cardholder.
When you apply for or manage a card for someone else, you tell us the basis of your authority, and you promise that it is true and current. The bases we accept are:
We may ask for a document that shows your authority, such as a power of attorney or a court order, and we may decline or end your approver role if you do not provide it. You must tell us within 30 days if your authority ends, is limited, or is challenged.
A card for a cardholder aged 13 to 17 is issued on your own account. You are the account holder, we verify your identity as the law requires, and you are responsible for every transaction on the card as if you had made it yourself. The minor is an authorized user.
You consent to our collecting the minor's name, date of birth, and any email address or phone number you choose to give us, only to issue and operate the card and to send the minor the messages you allow. When the minor turns 18 the card stays on your account until it is closed or the cardholder opens an account of their own.
An adult cardholder you help keeps their own account and is responsible for it. Before their card is issued, we ask them to confirm, through a link sent to them, that they agree to you acting as their approver. If they do not confirm, the card is not issued.
Where your authority rests on the cardholder's consent alone, they may end it by contacting support. Where it rests on a power of attorney, guardianship, conservatorship or representative payee appointment, it ends when that authority ends.
If a purchase is sent to you for review and you do not answer in time, it is declined. ShapeCard does not decide for you.
You agree that you will:
If you choose to be the payer, money you add moves from your linked bank account under the Bank Transfer (ACH) Authorization Terms. For a supervised adult's own account, money you add belongs to that account, and you cannot take it back except through a refund the cardholder or the law allows. For a minor's card on your account, the money stays yours.
To let you act as approver, we show you the card's transactions, rules, balance and alerts. A supervised adult agrees to this when they confirm you as their approver. We handle all of it as the Privacy Policy describes.
ShapeCard takes reasonable steps to check what you tell us about your authority, but we do not give legal advice, we are not a fiduciary for you or the cardholder, and we are not responsible for decisions you make as approver. Disputes between you and the cardholder about the card are between you and the cardholder. ShapeCard is not a party to that dispute.
You may stop being an approver by contacting support@shapecard.ai. For a minor's card on your account, the card is closed. For a supervised adult, we tell them, and their card stays paused until they confirm how they want to continue. We may end your approver role if you break these terms or if your authority ends.
You accept these terms by checking a box with the statement below. We may change them as the Cardholder Agreement describes.
"I agree to the Approver and Delegated Authority Terms. I confirm that I have the legal authority I described for each person I manage, and that the information I gave about it is true."
